Two things: 1) Jessica didn't tell Malone about Mike bc it wouldn't have made a difference at this point. He stopped trusting her bc she wouldn't let him completely in and now she can't rectify that anymore. So there was really no point in telling him the truth now. 2) Harvey doesn't "go there" with Donna for two reasons: Donna once said she has a rule that doesn't sleep with men she works with and Harvey wants to honor that. Also: Harvey has some real issues and being with Donna, he's afraid he'd blow it up and losing Donna is as he said something he cannot handle. So he'd rather let things stay as they are then change them and eventually maybe lose her.
